The Affordable Care Act

The 2010 Patient Protection and Affordable Care Act (ACA) has provisions likely to increase tobacco interventions in healthcare, among them:

  • Section 3014 of the Affordable Care Act, (P.L. 111-148 and P.L. 111-152) requires the establishment of a federal “pre-rulemaking process” for the selection of quality and efficiency measures for specific qualifying programs within the Department of Health and Human Services (HHS).   • Accountable Care Organizations were authorized and final rules have been published. The rule includes 33 quality measures, including tobacco, and they mirror meaningful use measures. Several alternative payment options are included (see Payment Reform page).
